Recent reports by Network World and Michael Osterman suggest a 'shocking lack of e-mail retention policies'.  Network World cites the confusion over interpreting SEC/NASD rules, while Osterman says 45% of organizations, not only on Wall Street, do not have, yet should have policies or systems in place to prevent users from deleting important e-mail.

Similarly, The National Association of Securities Dealers (NASD) in June informed its roughly 5,300 brokerage firm members in that they must retain their instant-messaging records for at least three years. "Firms have to remember that regardless of the informality of instant messaging, it is still subject to the same requirements as e-mail communications" Mary Schapiro, NASD vice chairman and president of regulatory policy and oversight, said.

California Security Breach Information Act - it means more than you think
California law 1798.82 went into effect on July 1, 2003. It mandates that companies that do business in California or have customers in California notify customers whenever there is a known - or simply suspected - unauthorized distribution of their personal information such as SSN, Driving License number etc..
